In India, the importers and exporters have to follow strict rules and regulations to import rubber scrap and foray into this industry. What is Rubber Scrap?
Rubber scrap, unlike steel scrap, undergoes a different type of process before it can be used again and the rubber obtained at the end of this process is referred to as reclaimed rubber. The rubber reclaiming industry is a specialized industry which resembles its parent industry in overall development and growth. Recycled rubber is used in a lot of innovative ways. From reducing waste to improving safer playground surfaces to lower the chances of injuries for athletes, and building lower-impact hospital floors for nurses on their feet, this rubber scrap is being reused in numerous ways.
In 2020, India imported almost $13.8M worth of Scrap Rubber, thereby becoming the 6th largest importer of Scrap Rubber worldwide. In the same year, Scrap Rubber was the 761st most imported product across the country (India). India imports Scrap Rubber mainly from countries including the United States, United Arab Emirates, United Kingdom, Italy, and Australia.
Permission from the Environment department to import Rubber and Rubber articles
Almost all nations have an environmental department that regulates the import, consumption and usage of materials affecting the environment. Permission from such environmental departments of importing countries is important when importing used rubber. In India, Ministry of Environment, Forests & Climate Change (MOEF&CC), is the authorized Government Agency that regulates these kinds of materials including importation.
Import of hazardous waste
The businesses planning to foray into this sector must complete all the legal formalities. Since the environment and even human beings are affected by the usage of hazardous items, it is important that these must be disposed of in an organized manner. Proper hazardous waste management needs to be adhered to during the collection, recycling, treatment, disposal, and transportation of hazardous wastes.
The businesses must take permission from MOEF and only after getting the permission, the Custom authorities allow the imports of the rubber scrap.
Test report of analysis from Laboratory to import Rubber and Rubber articles.
To import used rubber, the importers need to get a test report from an accredited laboratory authorized or governed by importing country. Also, they need to produce the necessary sample of imported rubber scrap according to the procedures and rules of importing country and submit the same to an authorized laboratory and obtain an analysis report.
In most cases, three sets of samples of imported rubber scrap are required and forwarded to the laboratory notified by the MOEF or the Central Pollution Control Board (CPCB).
MOEF rules for rubber scrap import
The business entities need to possess Consent to Operate (CTO) & Hazardous Waste Management Authorization from State Pollution Control Board (SPCB).
The import of rubber scrap with a particular code is allowed to registered recyclers without a DGFT license.
Several items are restricted for the import.
Second hand goods can be used in place of capitals goods.
The business entity needs to have IEC details
Rubber scrap recyclers must have facilities prescribed by the CPCB.
Some important points for MOEF NOC
1- The import of rubber scrap will be as per the MOEF.
2- The inspection will be done by MOEF.
3- For record purposes photography is allowed.
4- The importers must have an approval letter from the MOEF office.
How to get a MOEF certificate?
Post completing all the legal steps and successful completion of the procedure by MOEF, the business entities will be provided with a certificate.
In India, export and import trade gets a clear signal from the ministry of environment and forest. The occupier intending to export and import has to submit the duly filled application form to the MOEF along with the relevant proof of insurance.
Decision of MOEF for rubber scrap
The proposal for the import and export of restricted items is considered & taken by the MOEF. The decisions to allow or hold the import will be taken under the guidance of the concerned Ministry in India. Post all the formalities, the exporters and importers will be allowed to import rubber scrap.
Instruction by MOEF for rubber scrap import
1- All the importers and exporters have to maintain a record of hazardous wastes for inspection purposes.
2- The importers must ensure that the present shipment is accompanied by the required paperwork and all rules have been followed.
3- To get other queries resolved, the importer can connect with the Ministry during working hours.
4- The applicants applying for the first time at MOEF can contact the expert committee to get professional help.
5- The importers have to submit an online application in the MOEF portal along with a hard copy as well within the given period only. Also, submit all the required documents along with the application to the MOEF by post.
